Welcome to Wendy Dashwood’s privacy policy. We respects your privacy and is committed to protecting your personal data.

This Privacy Policy tells you how we use and look after your personal information when you visit our website. This includes information you may provide when you sign up to receive communications from us, purchase a product or service, or take part in a competition.

It also tells you about your privacy rights and how the law protects you.

It is important that you read this Privacy Policy together with any other privacy notices on our website from time to time, so that you are fully aware of how and why we are using your data.

This website is not intended for children and we do not knowingly collect data relating to children. Thank you.

Who we are

This is the website of Wendy Dashwood – Artist and Blogger.  Wendy is a self-taught artist and writer who promotes her art via this website.  Through this website she blogs about her developing skills as an artist and her experiences along the way.  Our website address is: http://wendydashwood.com. What personal data we collect and why we collect it

Personal data, or personal information, means any information related to an identifiable living person.  It does not include data where the identity has been removed (anonymous data).

The Data we collect about you.

We may collect, use, store and transfer different kinds of personal data bout you which we have group together as follows:

Identity Data:  includes first name, last name and email address

Contact Data:  includes billing address, delivery address, email address and telephone number

Financial Data:  includes payment card details.  We do not store or process your card details ourselves, they are processed and stored via one of our contracted third-party service providers, through whom we sell our art works.  Any personal sales made by individuals through us are made via PayPal and payments are encrypted through your browser and transferred securely to process a payment.

Transaction Data:  includes details about payments to and from you and other details of products and services you have purchased from us or our sellers.

Technical Data:  includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access this website.

Profile Data:  includes your user name and password, purchases or orders made by you.

Messaging Data: includes messages sent to or received from us to purchases or making an offer on an Artwork.

Marketing and Communications Data: includes your preferences in receiving marketing from us and our third parties and your communication preferences

Special Categories of Personal Data:  We do not ordinarily collect special categories of personal data.

How is your Personal Data collected?

We use different methods to collect data rom and about you including through:

A)   Direct Interaction

You may give us your Identity Data, Contact Data, Transaction Data, Profile Data, Financial Data and Marketing and Communications Data by using our website, filling in forms, or by corresponding with us by post, phone, email or through your business card or LinkedIn profile. This includes personal data you provide when you:

  • Purchase or Commission an Artwork
  • Request marketing to be sent to you
  • Use features of our website such as favouriting and following or messaging us
  • Enter a competition, promotion or survey; or
  • Give us some feedback

B)  Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment. Visitor comments may be checked through an automated spam detection service.

C) Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

D)  Contact forms – Cookies

If you submit your personal details to us via a contact form, your information will be stored securely.  The legal basis upon which we collect and retain this data is for marketing purposes via email and to promote products to you.  You are free to unsubscribe from the website at any time.

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you have an account and you log in to this site, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

E)  Embedded content from other websites

Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracing your interaction with the embedded content if you have an account and are logged in to that website.

Who we share your data with

Social Media Features and Widgets

Our Site includes social media features, such as the Facebook Like button, and widgets, such as the “Share This” button or interactive mini-programs that run on our Site. These features may collect your IP address, which page you are visiting on our Site, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third-party or hosted directly on our Site. Your interactions with these features are governed by the privacy policy of the company providing it.

Does this Privacy Policy apply when I access third- party websites?

You may be able to access third-party websites directly from the Site. However, this Privacy Policy does not apply when you access third-party websites. We cannot control how third parties may use personally identifiable information you disclose to them, so you should carefully review the privacy policy of any third-party website you visit before using it or disclosing your personally identifiable information to its provider.

Third-Party Sources of Data and Sharing Data

We also collect and share data as described below:

Sellers – when you place an order for an artwork, (or you purchase direct from them via a link from our website), we share your information with the relevant seller(s) on our marketplace (“Seller”).

Cloud storage providers – use cloud computing platforms that securely store all of our data, including customer details

Email service providers – in order to send you marketing content and transactional emails, we share your details with our email service providers

Analytics tools – we use analytics tools to track the way that users interact with our website

Social Media Platforms – we may make your name and email address available to companies in order to advertise and market our services to you through other platforms on the internet (e.g. Facebook).  See ‘Marketing’ section of this Privacy Policy above.

Payment providers – in order to facilitate any payments made on our site, we facilitate the sharing of your Financial Data with payment providers.

Delivery providers – in order to package and mail your orders to you, it is necessary to share your information with delivery providers

Generally we do not rely on consent as a legal basis for processing your personal data other than in relation to certain direct marketing.  You have the right to withdraw consent to marketing at any time.

We have set out below a description of all the ways we plan to use your personal data, and which of the legal bases we rely on to do so.  We have also identified what our legitimate interests are where appropriate.

Marketing and Promotions

We strive to provide you with choices regarding certain personal data uses, particularly around marketing and advertising.  Please see your preferences page on the website for more information and to save your choices.

We will only ever send marketing in accordance with your preferences that we have recorded for you.  You will receive marketing communications from us if you have requested information from us or purchased goods or services from us or Sellers who represent us, or if you have provided us with your details when you entered a competition, and, in each case, you have not opted out of receiving that marketing.

We will always offer a way to opt out of receiving marketing communications in every marketing communication sent to you.  We may on occasion send out postal marketing for the purpose of growing our sales which is in our legitimate interests and in this case we will rely on you to let us know if you do not want to receive this by opting out of marketing (see Opting out below).

Third-Party Marketing

We will always seek your express opt-in consent before we share your personal data with any third-party for them to market their products or services to you in their own right. We will never share your personal data with third-parties without your consent.

How long we retain your data

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.  For example, details of your orders will be kept for as long as we need to retain that data to comply with our legal and regulatory requirements.  This is generally 7 years unless the law prescribes a longer period.

What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

Opting out

You can ask us to stop sending you marketing messages at any time by logging into your preferences page, by following the opt-out links on any marketing message sent to you or by contact us at any time.

If you opt out of receiving email marketing from us, we will no longer share your email address with social media platforms (see ‘External Third-Parties’).  Where you opt out of receiving these marketing messages, this will not automatically apply to personal data provided to us as a result of the purchase of an Artwork, unless you specify this when you opt-out.

How can I change, delete, or update my information?

If you have any questions about what information is stored or would like to obtain a copy of such information, please contact us at admin@wendydashwood.com After receiving proof of your identity, we will provide the information to you, and you may request that we delete or change any or all of the information. We will respond to your request to access within thirty (30) days of receipt.

We will retain your information for as long as long as needed to provide you services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Unless stated otherwise, our current Privacy Policy applies to all information that we have about you and your account.

Where we send your data

Some of our external third-parties are based outside the European Economic Area (EEA), so their processing of your personal data will involve the transfer of data outside the EEA.

Whenever we transfer your personal data out of the EEA, we ensure a similar degree of protection is afforded to it in accordance with data protection laws.  Some examples of how we might do this are:-

The transfer of your personal data is to countries that have been deemed to provide an adequate level of protection for personal data by the European Commission.

Data Security

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed.  In addition, we limit access to your personal data to those employees, agents, contractors and other third-parties who have a business need to know.  They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

You acknowledge that the internet is not a completely secure medium for communication and, accordingly, we cannot guarantee the security of any information you send to us (or we send to you) via the Internet.  We are not responsible for any damages which you, or others, may suffer as a result of the loss of confidentiality of such information.

We require all third parties to respect the security of your personal data and to treat it in accordance with the law, and they may only use your data for the purposes we specify in our contact with them.  We will always work with them to protect your privacy.

Your Legal Rights

Request Access to your personal data (commonly known as a “data subject access request”).  This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.

Request Correction of the personal data that we hold about you.  This enables you to have any incomplete or inaccurate data we hold about you corrected, tough we may need to verify the accuracy of the new data you provide to us.

Request Erasure of your personal data.  This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it.  You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law.  Note, however, that we may not always be able to comply with your request for erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.

Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms.  You also have the right to object where we are processing your personal data for direct marketing purposes.  In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.

Request Restriction of processing of your personal data.  This enables you to ask us to suspend the processing of your personal data in the following scenarios: (a) if you want us to establish the data’s accuracy; (b) where our use of the data us unlawful, but you do not want us to erase it; (c) where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or (d) you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.

Request the Transfer of your personal data to you or to a third-party.  We will provide to you, or a third-party you have chose, your personal data in a structured, commonly used, machine-readable format.  Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a transaction with you.

Withdraw Consent at any time where we are relying on consent to process your personal data.  However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you.  We will advise you if this is the case at the time you withdraw your consent.

You will not have to pay a fee to access your personal data (or to exercise any of the other rights).  However we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive.  Alternatively we may refuse to comply with your request in these circumstances.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights).  This is a security measure to ensure that personal data is not disclosed to any personal who has no right to receive it.  We may also contact you to ask you for further information in relation to your request to speed up our response.

Time Limit to Respond

We try to respond to all legitimate requests within one month.  Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests.  In this case, we will notify you and keep you updated.
